CONDITIONS

REACH REGULATION

Application of Regulation No. 1907/2006, as amended and revised.On 1 June 2007, the new regulatory system (REACH - REGULATION (EC) No. 1907/2006) concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH), and control over the placing of chemical substances and preparations on the European market came into force throughout the European Union.The REACH Regulation requires all chemicals produced in or imported into the European Union in volumes exceeding 1 tonne/year to be registered with the European Chemicals Agency (ECHA). In this regard, it should be noted that Novellini S.p.A. only acts as a downstream user, as it does not produce substances in the EU or import substances into the EU; therefore, it is not required to fulfil the obligations relating to the registration of these substances.  

Unless otherwise agreed in writing with the customer (the “Customer”), the following terms of sale apply to the sales of products of Novellini S.p.A. (“Novellini”):
    We would like to point out that all our products fall under the definition of an article given in Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006, as amended and revised. More specifically, pursuant to Article 7 “Registration and Notification of Substances in Articles” subsection 1 (b), such articles are not subject to registration because any substances they contain are not intended to be released under normal or reasonably foreseeable conditions of use. We would also like to point out that, again in accordance with Regulation (EC) No. 1907/2006, as amended and revised, the aforementioned articles, on the basis of their characteristics, do not fall under the obligations provided for in Article 33 “Duty to communicate information on substances in articles” as the percentage by weight of the substances considered hazardous, in accordance with this regulation, is less than 0.1% of the total weight of the article. 

 

 

CONDITIONS OF SALE 

Unless otherwise agreed in writing with the customer (the “Customer”), the following terms of sale apply to the sales of products of Novellini S.p.A. (“Novellini”):

 

ORDERS

Orders sent to Novellini shall be binding for the Customer, while they have the value of a mere proposal for Novellini (and, therefore, shall not be binding), until Novellini receives its order confirmation countersigned by the Customer for acceptance.It is only from this moment that the delivery and/or collection time (lead time) indicated in the order confirmation begins. Orders will be dispatched when ready, except for those orders for which a precise delivery date was stated when they were transmitted. Novellini reserves the right to make changes, including partial changes, to the products, as well as to decide on their removal from the catalogue, even without prior notice. The equipment and colour shades in the photographs are purely approximative.

 

ORDER CANCELLATION

No order cancellation will be accepted without the prior and express authorisation of Novellini. The latter reserves the right to charge any consequent expenses and costs, which will be calculated according to the progress of production.   

 

SPECIAL ORDERS

Any orders with special equipment must be accompanied by an advance payment equal to 25% of the taxable price value. No returns or cancellations will be accepted by Novellini on such orders. 

 

LEAD TIMES

Lead times are purely approximative and shall under no circumstances constitute grounds for total or partial cancellation of the order, nor for any claim for compensation for any reason.

 

PRICES AND PAYMENTS

The sales prices are those in the official price list on the date the order is concluded. Novellini reserves the right to change these prices even without prior notice in the event of increases in production costs and raw materials. Existing orders scheduled for delivery more than 60 days after the date the new price lists come into force shall be subject to the new pricing regime.The terms of payment are those agreed specifically for each customer. In the case of new customers, or changes to the conditions, these conditions shall be expressly agreed upon at the time of the order.In the event of non-payment or payment after the agreed due date, the Customer shall be charged default interest, from the due date and without the need for a formal notice of default, pursuant to Italian Legislative Decree No. 231/2002, as amended.  

 

PACKING

The agreed price for Novellini products includes standard packing. In the case of special transport and consequent packing requirements, a special price will be agreed upon according to the additional cost incurred. The iron pallets used to transport Novellini products shall be considered “to be returned” as they are the property of Novellini. In the event of failure to return the pallets, Novellini reserves the right to charge the customer for their value. These iron pallets were designed exclusively for use with the vendor's products. The vendor shall not accept any liability for improper use of this property.

 

WARRANTY

The goods are covered by warranty according to the Novellini contractual warranty. This warranty is valid for 2 years from the date of delivery of the product and any claims will only be taken into consideration following a written complaint and proof of purchase. The warranty will not apply if, in the event of a conformity defect that can be identified when the packing is opened, the product is nevertheless installed and the defect is only reported at a later time. 

 

RETURNS

Novellini products may only be returned following specific written authorisation from Novellini.If a return is requested due to an error made by the Customer in the purchase, the general restoration and storage costs shall be at the Customer’s expense, provided that the product is intact; if the product is damaged or its packing is not intact, the company reserves the right to assess the value to be credited on a case-by-case basis.

 

LEGAL DISPUTES

These conditions are fully accepted by the Customer when it places an order with Novellini. For any disputes in this regard, the Court of Mantua shall have sole jurisdiction.

 

This price list cancels and replaces the previous price lists. The images and data contained in this catalogue are to be considered approximative and are subject to change without notice.
